The following represents the terms and conditions for using our website, products, and services. Please do well to read and fully understand the terms of this contract, as it is a legal statement which serves as an agreement between Darrel Technologies and all visitors to our website. By accessing this site, you agree to these terms and conditions:

We reserve the right to edit these terms and conditions, including but not limited to, all products, services, prices, and software displayed on this site at any time, without prior notice. We also reserve the right to seek all remedies available by law and in equity for any violation of these terms and conditions. Any rights not expressly granted herein are reserved.

All materials contained in this website are the copyright property of Darrel Technologies Ltd. Ghana, its subsidiaries, any third party affiliates, and/or partners. Unless otherwise expressly specified, the materials and services on this website are for your personal and non-commercial use, and you may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the website without the written permission of Darrel Technologies.

2. Disclaimers and Warranties

Except otherwise stated, all information on this web site is provided “as is” without warranty or conditions of any kind, either express or implied. This is a dynamic Web site, including information and inputs from colleagues as well as the site authors. In preparing this site, effort has been made to offer information as accurately as possible. However, inadvertent errors can occur, and applicable laws, rules and regulations often change.

Darrel Technologies Ltd. therefore assume no responsibility for inaccuracies, errors or omissions in the information or software or other documents which are referenced by or linked to this web site.

3. Payment of Bills

By using our services you agree to supply appropriate payment for the services received from Darrel Technologies, in advance of the time period during which such services are provided. You agree that until and unless you notify Darrel Technologies of your desire to cancel any or all services received, those services will be billed on a recurring basis. This includes when accounts are suspended. When an account’s invoices are paid outside of the 5-day grace period, invoices will not be automatically generated. However, after the customer notifies Darrel Technologies of his or intent to resume service, invoices will be manually generated and payment expected for the time the account was suspended.

Account Setup

We will only setup your account after we have received FULL payment due for your order and we and/or our payment partner(s) have screened the order(s) in case of fraud. ** It is your  responsibility as a D-Tech customer to prove beyond all reasonable doubt the legitimacy of any orders made through our website. And we reserve the right to not process any orders that have been deemed to be fraudulent.

Bank Deposit Verification / Payment Notification

Darrel Technologies accepts payment via Bank Deposit in Ghana. Clients looking to utilize this payment option are required to complete a Verification form on this website after making payments in order to notify Darrel Technologies of any such payments.

Any payments for which we have NOT been duly notified using the bank verification form will be considered unpaid until such a time as when we have been notified of the said payment via the bank verification form. As such, any Invoices, Debit Notes or other Transaction charges linked to such payments will remain unpaid until such a time as we have been duly notified via the bank verification form.

Over Payment and Overages

When you place an order on our site, you receive an Invoice containing the Total Pending amount due for your order. This amount will include VAT + NHIL charges. You are expected to pay the exact amount stated for your order, including these charges.

If you have “overpaid” for an Invoice via Bank Deposit, you are required to notify us immediately of any such overages via the Bank Deposit form for that invoice.

Note: Darrel Technologies will NOT be held liable for any overages paid via Bank Deposit, unless specifically instructed as to how to handle such overages via the Bank Verification form. We may issue refunds on such overages at our sole discretion, and we reserve the right to refuse refunds of any such overages. In such a case that over payments are reported, we can only credit such overages to the customer’s D-Tech account.

Please note also that only amounts that are less than or equal to 20% of the total amount billed will be considered a payment overage. As such, we will NOT credit any over payments made that are more than 20% of the actual amount billed. You can always add funds to your advance account with us, which can be applied to future invoices, by clicking here.

4. Submissions

For each visitor to our Web Site, our Web server automatically collects visitor information to include their domain name — but not the e-mail address — of visitors to our web pages, aggregate information on what pages consumers access or visit, user-specific information on what pages consumers access or visit and information volunteered by the consumer, such as survey information and/or site registrations.

The information we collect is used solely for internal review purposes, used to improve the content of our Web site, used to notify consumers about their products / services and updates to our Web site, and not shared with other organizations for commercial purposes.

5. Fraud Screening

Each order placed through our website goes through a series of internal and external fraud checks, and in the event that an order is flagged as being suspicious, additional information including but not limited to: identification and legal registration documents (in the case of a company/business), may be required to process the order. This will typically be in the form of a ticket from our Abuse desk, requesting information to aid in determining the legitimacy of the said order.

The customer hereby agrees to supply such information as would be required to verify the legitimacy of the said order. The customer further acknowledges that if we are unable to determine the legitimacy of the order, the order will be cancelled as fraudulent.

6. Registration and Account Security

If any of the services on the website requires you to register or open an account, you must complete the registration process by providing us with true, current, complete and accurate information as prompted by the applicable registration form, and you will maintain and promptly update such information to keep it true, current, complete and accurate.

Should you be required to choose a password and a user name, You will be entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

We will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Darrel Technologies or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder, and you also agree to maintain a single account at any point in time.

You acknowledge and agree that certain services may provide password-restricted access to customer information such as names and certain terms of your contracts. By using this website and registering for such services, you consent to our display of such information via the services and accept all risks of unauthorized access to such information.

If you provide any information that is false, inaccurate, out of date, or incomplete, or Darrel Technologies has reasonable grounds to suspect that such information is false, inaccurate, not current, or incomplete, we may suspend or terminate your account and refuse any and all current or future use of the services or any portion thereof. You are responsible for all costs and charges, including without limitation, phone charges and telecommunications equipment, that you incur in order to use the services.

7. Compliance with laws

You agree that all matters relating to your access to, or use of this web site shall be governed by the laws of the Republic Of Ghana.

Darrel Technologies makes no representation that information on this web site are appropriate or available for use in all countries, and prohibits accessing materials from territories where contents are illegal. Those who access this site do so on their own initiative and are responsible for compliance with all applicable laws.

8. Privacy

We may collect some information about you when you order an item, or create an account on this site. Personal information collected on this site is not shared with any third parties, and is only kept for a while and discarded, if necessary, after use. We may collect your: name, email address, telephone number and other demographic information necessary to complete your transaction.

In the event that information will is required on this website, information use will be governed by the terms stated in our privacy policy.

9. Cancellations and Refunds

Certain products on our website are subject to a Money Back guarantee. Should such products be cancelled within this rebate period, the customer’s D-Tech (online) account will be credited with the total amount paid for such an order.

Customers may also request a Physical (cash or monetary), which will be issued via direct bank deposits, provided that such a product falls within the rebate period. If a physical refund requested, the total amount paid for any such product shall be subject to a Processing Fee of 35% of the total amount billed for the order.

Note: Darrel Technologies places absolutely no warranty on products not expressly covered by our money back guarantee. Additionally, should a product be canceled for failure by the customer to meet any requirements that may be in force for the said product, Darrel Technologies is under no obligation to offer a refund and we may at our sole discretion choose to provide a refund. Should a refund be approved, the terms under this section shall be enforceable.

Refunds on electronic payments

  • Card payments (Visa, Mastercard etc) and PayPal: the customer acknowledges that Darrel Technologies Limited is not a payment processing company and therefore, utilizes the services of third parties for processing card and electronic payments. Such payments are typically aggregated on behalf of Darrel Technologies Limited. We may reverse the transaction only if the sale has not been duly paid out by our card processors. If a refund is approved by our billing team, refunds will be subject to a 25% processing fee.
  • Offline mobile wallet payments: refunds issued on payments made via direct wallet transfers are subject to a 15% processing fee.

Non-refundable channels

The following methods of payments are non-refundable, and refunds will be posted as credit to the customer’s D-Tech account:

  • Online mobile money payments (OPR)
  • Wire Transfers
  • Money orders

Fraudulent orders

Darrel Technologies is not obligated to process refunds for orders that have been determined to be fraudulent, or orders made through customer accounts that have been shown to be involved in fraudulent activity, and we reserve the right to NOT process refunds for any such orders or customer accounts, regardless of whether or not those orders have been processed.

Important: Tax Charges (e.g. VAT+NHIL) are non-refundable. Also, payments made for Dedicated servers are non-refundable at this time.

10. Tax Laws

Products and services on display on our website are subject to the Tax regulations of the Republic of Ghana. We offer a variety of payment options for your order, including online and offline payment. Unless otherwise stated, all payments are subjected to tax rates representing a percentage of the initial product cost (subtotal), which MUST be paid in addition to the actual/initial amount charged for the product/service. The following taxes apply to billing invoices:

  • National Health Insurance Levy (NHIL) 2.5% of subtotal
  • GETFund 2.5% of subtotal
  • COVID-19 HRL 1% of subtotal
  • Value Added Tax (VAT) 15 % of sum of sub total and above levies

Total tax: 22%

11. Late fees

All invoices issued by our billing systems are assigned a due date. Customers are required to pay for their invoices on or before this due date. A late fee of 15% of the total amount charged will be applied to any invoices that are left unpaid for up to 10 days, and the customer will be required to pay this amount in addition to the actual amount billed for that invoice.

Note: this late fee does NOT in any way change your billing cycle. You will continue to be billed according to your initial billing cycle, regardless of when you pay for this fee.

12. Credit Card Processing & Other Electronic Payment Service Fees

We accept payment for products and services purchased on our website via Credit/Debit Cards and PayPal. A  processing fee of 5.5% of the total amount will be charged per transaction, and customers looking to use these payment option will be required to pay this processing fee in addition to the actual amount billed for their invoices.

13. Direct Mobile Wallet Payments

Starting on Friday, 20th February 2015, we shall be accepting payments via direct mobile wallet transfers in Ghana. Customers who choose to use this payment option are advised to include the correct reference number during the transaction, as we will not be liable for any discrepancies. Customers are equally advised to pay the exact amounts billed on their invoices, as we will not be responsible for any overpayments.

** Payments made via this payment option will only be applied to customer invoices once such payments have been determined to be up to the amount billed for the invoice(s).
